These terms and conditions (“Agreement”) set forth the general terms and conditions of your use of the beachykeencreative.com and services, specifically the AI Brand Photoshoots. This Agreement is legally binding between you (“User”, “you” or “your”) and Beachy Keen Creative (“Beachy Keen Creative”, “we”, "I" “us” or “our”). If you are entering into this Agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this Agreement, in which case the terms “User”, “you” or “your” shall refer to such entity.

Service Overview

Beachy Keen Creative provides AI-generated brand photos based on client-submitted reference images. These images are digitally created artistic renderings meant to reflect your unique essence, not exact photographic replications.

• This service includes a custom set of AI-generated images based on the client’s selected style, location, outfit, and poses.
• The delivery timeframe will be outlined in the product description or communicated directly.
• Clients must provide at least 20 high-quality reference photos for the AI model to be trained accurately.
• Once the AI model (LoRA) used to generate your images has been processed and finalized, it will be deleted after project completion, unless otherwise requested in writing before final delivery.

Client Responsibilities & Acknowledgments

By purchasing, you agree that:

• You have the legal right and permission to submit the reference photos provided.
• You understand that AI technology has limitations, and results may vary from traditional photography.
• AI-generated images are not a perfect replica but an interpretation based on the provided photos and chosen styling.
• Refunds are not available once processing begins, as this is a digital and custom service.
• By purchasing, you agree to be added to the Beachy Keen Creative newsletter for updates, insights, and offerings. You may unsubscribe at any time.

Ethical & Content Restrictions

I maintain full discretion over the projects I accept. The following guidelines apply:

• Permission & Consent: I will only create AI-generated images of a person with their express permission. Submitting another person’s images without consent is strictly prohibited.
• No Nudity or Near-Nudity: I do not create AI-generated images containing nudity, lingerie, overly revealing clothing, or any content that I deem inappropriate.
• No Illegal or Harmful Content: I will not generate images that depict illegal substances, violence, hate speech, or anything that violates ethical or legal standards.
• Right to Refuse: I reserve the right to decline any project that does not align with my personal comfort level, values, or business ethics. If a project is declined after purchase, a full refund will be issued.

Usage Rights & Ownership

• You own the final AI-generated images and may use them for personal or business branding.
• Beachy Keen Creative retains the right to use the images in marketing materials, portfolio displays, or promotional content unless you request in writing to opt out.
• The images must not be used to misrepresent identity, impersonate others, or create misleading/fraudulent content.
• No modifications should be made that could mislead audiences or violate ethical standards (e.g., deepfake-style alterations).

Revision & Editing Policy

My goal is to create images you love and feel aligned with your brand. However, AI generation has limitations, and I maintain boundaries on edits and replacements:

• Two rounds of revisions are included.
• If an image does not feel aligned, I will provide one replacement or edited image per misaligned photo per round of revisions.
• Minor color adjustments or refinements may be provided at my discretion.
• I do not offer unlimited edits.
• Requests must be made within 7 days of receiving your final images.

Refunds & Cancellations

Due to the nature of this digital service, refunds are not available once the AI rendering process has started. If you wish to cancel within 7 days of purchase, and before processing begins, a full refund will be provided.

A 50% refund will be issued if a refund is requested after 7 days, and before processing begins.

If I do not receive a response from you within 14 consecutive days after two attempts to contact you, at any point after purchase and during the service process, your service may be considered forfeited, and no refund will be issued.

Limitation of Liability

• This service is provided as is, and while I strive for accuracy and quality, I cannot guarantee perfection due to the nature of AI technology.
• I am not responsible for business outcomes, reputational harm, or unintended consequences resulting from the use of AI-generated images.
• By purchasing, you acknowledge and accept the creative and technological limitations of AI.
